Terms of Service

By accessing and using the Lundquist Surfboards website and placing an order, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our site or make any purchases.

These Terms of Service govern your use of our website, products, and services. Lundquist Surfboards reserves the right to update or modify these terms at any time without notice. Your continued use of the site constitutes acceptance of any changes.

1. Custom Board Policy

Built to Order

All Lundquist Surfboards are custom-built to order. Each board is uniquely crafted based on your specifications and may not be an exact replica of stock items.

Production Timeline

Standard production time is 4–8 weeks from order confirmation, depending on board complexity and our current queue. Custom boards with unusual specifications may require additional time. We will provide an estimated completion date at the time of order.

Deposits and Cancellation Policy

A 50% deposit is required at the time of order to secure your slot in our production queue. The remaining 50% is due upon shipment. Once production begins (shaping has started), orders cannot be cancelled and deposits are non-refundable. We will notify you when your board enters production.

Design Customization

You may customize the following elements: board dimensions (length, width, thickness), shape, rocker, bottom contours, rail profile, foil, finish (gloss/matte), decal placement, and color preferences. We reserve the right to decline specifications that are physically impossible or unsafe to produce.

2. Pricing and Payments

All prices are displayed in USD and include materials and labor. Prices are subject to change without notice. The price at the time of order confirmation is the price you will pay.

Payment Methods

We accept credit cards, debit cards, and other payment methods as indicated on our checkout page. All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your account for the full board price.

Taxes and Fees

Prices do not include sales tax. If applicable, sales tax will be calculated and added at checkout based on your location. You are responsible for any applicable state and local taxes.

3. Shipping and Delivery

We ship custom boards via UPS or FedEx Ground (within Continental US). International shipping available upon request. Shipping costs are calculated at checkout and must be paid before shipment.

Risk of Loss

Risk of loss transfers to you upon delivery to the carrier (UPS/FedEx). We are not responsible for loss, damage, or delay caused by the shipping carrier. We recommend purchasing shipping insurance for high-value orders.

Delivery Address

You are responsible for providing an accurate delivery address. We are not responsible for delivery failures due to incorrect or incomplete address information.

4. Returns and Exchanges

Because all Lundquist Surfboards are custom-built to order, returns and exchanges are limited.

Manufacturing Defects

If your board arrives with a manufacturing defect (structural failure, delamination, voids, etc.), we will repair or replace it at no additional cost within 30 days of delivery. You must provide photographic evidence of the defect and contact us immediately.

Damage During Shipping

If your board is damaged during shipping, file a claim with the carrier immediately and contact us with photos. We will work with the carrier and may repair or replace the board. Shipping damage claims may take 30–60 days to resolve.

Change of Mind / Cosmetic Issues

Custom boards cannot be returned due to change of mind or cosmetic preferences (minor dings, slight color variations, finish imperfections). Custom products are non-returnable unless defective.

5. Intellectual Property Rights

All content on the Lundquist Surfboards website — including text, graphics, logos, images, and designs — is the property of Lundquist Surfboards or its content suppliers and is protected by copyright and trademark law.

Your License

You are granted a limited, non-exclusive license to view and download content from our site for personal, non-commercial use only. You may not reproduce, distribute, transmit, display, perform, or publish any content without our written permission.

Custom Board Designs

Custom designs you create using our customizer tool remain your property once you have purchased the board. However, you grant Lundquist Surfboards a non-exclusive license to use photos of your finished board for marketing purposes (website, social media, etc.) unless you opt out.

Prohibited Uses

You agree not to: copy, modify, or distribute content; use content for commercial purposes; remove copyright or trademark notices; or reverse engineer any software or technology on our site.

6. Product Liability and Assumption of Risk

Surfboarding is an inherently dangerous activity. You assume all risks associated with using a Lundquist Surfboard, including injury, property damage, or death. Surfboards are designed for water sports use only and are not safety devices.

Proper Use

Your Lundquist Surfboard is designed for recreational surfing in appropriate wave conditions. Misuse, abuse, or use in hazardous conditions may result in injury or board damage. We are not responsible for injury, damage, or loss resulting from misuse or improper use of our products.

No Warranty for Improper Use

Damage resulting from improper use, accidents, abuse, or neglect is not covered under our warranty.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUNDQUIST SURFBOARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER LOSSES ARISING FROM YOUR USE OF OUR WEBSITE OR PRODUCTS.

LUNDQUIST SURFBOARDS' TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR BOARD.

8. Disclaimer of Warranties

THE WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LUNDQUIST SURFBOARDS DOES NOT WARRANT THAT:

• The website will be uninterrupted or error-free
• Defects will be corrected
• The site is free of viruses or harmful components
• Your board will perform in any specific way or meet your expectations

Performance and durability depend on design, construction, materials, and proper use.

9. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Harass, threaten, or defame others
• Post spam, malware, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with the operation of our website
• Reverse engineer or attempt to access source code
• Use our website for commercial purposes without permission
• Violate intellectual property rights

10. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts located in Orange County, California, for the resolution of any disputes arising from these Terms of Service or your use of the website.

11. Dispute Resolution

Before pursuing legal action, we encourage you to contact us to attempt to resolve any disputes informally. Please contact us at blake@lundquistsurfboards.com with details of your concern.

If we cannot resolve your dispute within 30 days, you may pursue further legal remedies as permitted by law.

12. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies on our website, constitute the entire agreement between you and Lundquist Surfboards regarding your use of the website and purchase of products.

14. Changes to Terms

Lundquist Surfboards reserves the right to update or modify these Terms of Service at any time. Changes are effective immediately upon posting. Your continued use of the website constitutes acceptance of the updated Terms.
